Agreement and scope

“GOLMSKA,” “we,” “us” and “our” refer to GOLMSKA CORP. “You” refers to a visitor, customer or other user. These Terms apply to all users, including browsers, purchasers, vendors and content contributors. If you do not agree, do not use the website or place an order.

Our store is hosted by Shopify, which provides the ecommerce platform used to display products, maintain the cart and process checkout. Additional Shopify terms may apply to portions of the checkout experience.

Eligibility and account information

You must be at least the age of majority in your state or jurisdiction to make a purchase, or use the website under the supervision of a parent or legal guardian. You agree to provide current, complete and accurate purchase, delivery and contact information. You are responsible for activity conducted through any customer account and for protecting account credentials.

Products, specifications and availability

GOLMSKA sells golf clubs, golf balls, apparel, accessories and related field gear. Many products are released in limited batches. Displayed availability can change before checkout is completed. Adding an item to a cart does not reserve inventory.

We aim to present colors, materials, dimensions and specifications accurately, but screens, photography and manufacturing tolerances may create reasonable variation. Technical figures, launch data and performance comparisons describe controlled conditions and are not guarantees of individual results.

Pricing, orders and acceptance

Prices are shown in the currency identified at checkout and may change without notice. Taxes, shipping charges, duties and similar costs are added when applicable. Promotions cannot be combined unless the offer expressly allows it.

Your order is an offer to purchase. An automated confirmation acknowledges receipt but does not by itself constitute acceptance. We may accept, limit or cancel an order for reasons including inventory error, suspected fraud, payment failure, pricing error, shipping restriction, resale activity or violation of these Terms. If we cancel after payment has been captured, we will issue a refund to the original payment method.

Payment

Available payment methods are displayed in Shopify Checkout and may vary by location, device, order value and store configuration. Payment credentials are submitted to authorized payment providers through the secure checkout environment; GOLMSKA does not request that customers send full card numbers or security codes through email or contact forms.

You represent that you are authorized to use the selected payment method. Payment authorization may occur when the order is placed, while capture may occur immediately or when the order is accepted, depending on the method and checkout configuration.

Shipping and delivery

Processing estimates, delivery windows, geographic limitations, address requirements, risk of loss and procedures for delayed, missing or damaged packages are described in our Shipping Terms. Delivery dates are estimates rather than guarantees. Carrier events, weather, customs, peak demand and incorrect address information may cause delay.

Returns, refunds and exchanges

Eligible returns and refunds are governed by our Refund Policy. Unless the policy or applicable law provides otherwise, products must be returned in the stated condition, within the stated period and through the authorization process. Customized, personalized, final-sale, used or hygiene-sensitive goods may be ineligible.

Custom configurations and player guidance

Remote product guidance and Custom Atelier recommendations are based on information you provide. They do not replace an in-person fitting, medical advice or instruction from a qualified golf professional. You remain responsible for selecting the final specification. Products manufactured, altered or personalized to your submitted specification may have restricted cancellation and return rights, except when defective or required by law.

Permitted use

You may use the website only for lawful personal or legitimate business purposes. You may not interfere with security, test vulnerabilities without written permission, scrape at a rate that burdens the service, introduce malicious code, impersonate another person, use payment information without authorization, resell access, or use site content to create a confusingly similar brand or service.

Intellectual property

The website, brand names, photographs, product names, copy, graphics, layouts, code, trade dress and other materials are owned by or licensed to GOLMSKA CORP and are protected by intellectual-property laws. We grant a limited, revocable, non-exclusive and non-transferable permission to access the website for personal shopping and informational use. No ownership rights are transferred.

You may not reproduce, adapt, distribute, sell, publicly display or create derivative works from protected materials without written permission, except as allowed by law.

User submissions and feedback

If you submit reviews, photographs, feedback or other materials, you represent that you have the right to do so and that the material is accurate, lawful and does not violate another person’s rights. Unless we agree otherwise in writing, you grant GOLMSKA a non-exclusive, worldwide, royalty-free license to use feedback to improve products and services. We are not required to publish submitted material.

Third-party services and links

The site may rely on or link to third-party services such as Shopify, payment providers, shipping carriers or analytics providers. Their services are governed by their own terms and privacy practices. We are not responsible for third-party content or for outages and acts outside our reasonable control, although this does not limit rights that cannot be waived by law.

Disclaimers and limitation of liability

To the maximum extent permitted by law, the website and informational content are provided “as is” and “as available.” We do not warrant uninterrupted operation, complete freedom from error, or that equipment will produce a particular score, distance or competitive result.

To the maximum extent permitted by law, GOLMSKA CORP and its directors, officers, employees, contractors and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, lost profits, lost data or business interruption arising from the website or products. Where liability cannot be excluded, aggregate liability will not exceed the amount you paid to GOLMSKA for the product or order giving rise to the claim during the twelve months before the event. Some jurisdictions do not allow particular exclusions, so portions of this section may not apply.

Product safety and assumption of risk

Golf equipment must be used for its intended purpose and inspected for damage before use. Stop using any club, bag, accessory or apparel item that appears structurally damaged or unsafe. Golf involves inherent risks, including injury from clubs, balls, weather and course conditions. Nothing in these Terms excludes liability that cannot lawfully be excluded.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless GOLMSKA CORP from third-party claims, losses and reasonable expenses resulting from your unlawful misuse of the website, violation of these Terms, infringement of another person’s rights or unauthorized use of payment or account credentials.

Force majeure

We are not responsible for delay or failure caused by events beyond reasonable control, including natural disasters, severe weather, fire, epidemic, labor disruption, transportation interruption, carrier failure, cyberattack, government action, war, civil disturbance, supply shortage or utility outage. We will make reasonable efforts to communicate material order impacts.

Governing law and disputes

These Terms are governed by the laws of the State of Montana, without regard to conflict-of-law rules, and by applicable federal law. Before filing a formal claim, you agree to contact us and provide a reasonable opportunity to resolve the matter. Unless applicable consumer law requires otherwise, disputes will be brought in state or federal courts located in or serving Missoula County, Montana, and the parties consent to that jurisdiction.

Termination

We may suspend or terminate access when we reasonably believe a user has violated these Terms, threatened security, engaged in fraud or created legal exposure. Provisions that by their nature should survive termination will survive, including payment obligations, intellectual-property provisions, disclaimers and limitations of liability.

Changes, severability and entire agreement

We may update these Terms by posting a revised version and a new “Last updated” date. Changes apply prospectively unless law requires otherwise. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. These Terms and incorporated policies form the entire agreement regarding the website and store, unless a separate signed agreement applies.
